This Agreement (“Agreement”) is between you and WineOutlet (“Company”). This Agreement governs your use of this website (the “Site”) and any related online ordering or in-store pickup services provided by WineOutlet.By accessing or using this Site, you represent that you are at least 21 years of age and agree to comply with all applicable New Jersey State laws and regulations governing the purchase of alcoholic beverages.

YOUR USE OF THIS SITE AND PLACEMENT OF ANY ORDER CONSTITUTES YOUR ACCEPTANCE OF THIS AGREEMENT WITHOUT MODIFICATION. THIS AGREEMENT CONTAINS DISCLAIMERS OF WARRANTIES AND LIABILITY AND LIMITS YOUR REMEDIES (SEE SECTIONS 5–7).

You agree not to use the Site in any way that is unlawful, fraudulent, or intended to violate New Jersey Division of Alcoholic Beverage Control (ABC) regulations.

WineOutlet reserves the right to modify these Terms and Conditions without prior notice. Continued use of the Site after any change constitutes acceptance of the revised terms.

All orders placed through the WineOutlet website are for in-store pickup only at licensed WineOutlet locations in New Jersey. Orders will not be shipped or delivered.

At the time of pickup:

• The person collecting the order must be 21 years or older.
• A valid government-issued photo ID must be presented.
• WineOutlet reserves the right to refuse pickup or cancel any order if age or identity cannot be verified, or if required by law.

Prices, inventory, and promotions are subject to change without notice and are final at the time of payment. Product availability is confirmed at pickup.

All content, including logos, text, graphics, and images appearing on the Site, are the property of WineOutlet, its licensors, or third parties, and are protected by U.S. and international copyright and trademark laws.

You may not copy, reproduce, republish, distribute, or use any portion of the Site content without prior written permission from WineOutlet.

You may not:

• Use this Site or its content for resale, commercial redistribution, or derivative works.
• Republish or sell any content without written consent.
• Attempt to bypass security features or interfere with the Site’s operation.

IN NO EVENT SHALL WINEOUTLET BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN ONLINE ORDERING, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW SUCH EXCLUSIONS, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

YOUR EXCLUSIVE REMEDY AND WINEOUTLET’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE ORDER IN QUESTION.

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account. You agree to notify WineOutlet immediately of any unauthorized use of your account or any security breach. WineOutlet is not responsible for losses resulting from unauthorized access due to your failure to safeguard your login credentials.

All orders are subject to inventory verification and legal compliance. WineOutlet reserves the right to cancel or modify an order due to product unavailability, pricing errors, suspected fraud, payment authorization issues, or other circumstances beyond our control. If an item is unavailable, WineOutlet will notify you regarding available options, which may include order modification or cancellation.

Product images, labels, vintages, packaging, and descriptions are provided for informational purposes only and may differ from the actual product available at pickup. While we strive to maintain accurate information, WineOutlet does not guarantee that all product information is complete, current, or error-free.

WineOutlet reserves the right to correct pricing, typographical, promotional, or product description errors at any time and may cancel or refuse any order affected by such errors.

This Agreement and any disputes arising from your use of the Site or participation in online ordering shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions.
